WE COLLECT INFORMATION, BUT WE RESPECT INDIVIDUAL PRIVACY
We collect certain personally identifiable information ("Personal Information") to facilitate card sends, card pickups, and the personalization of our Site. You can choose not to provide us with certain information, but then you may not be able to take advantage of many of our features. The Personal Information you provide is used for such purposes as answering questions, sending product updates, fulfilling orders for Jockular merchandise, targeting advertisements to you, and communicating with you about our products and services, including specials and new features. We do not use the e-mail address contained in an E-Card for direct marketing purposes nor do we compile e-mail addresses to build mailing lists to sell to or share with marketers. We do use these addresses to facilitate card delivery and to assist in card pickups. E-mail addresses are also used help protect a recipient's privacy right to know the identity of a card sender. We also have an e-mail newsletter and periodically send e-mails to our subscribers. When you receive e-mail or our newsletter from Jockular, you can opt out of receiving further communications by following the included instructions to unsubscribe.
IP addresses and Information Shared with Card Recipients:
Jockular is not intended as to be used as an anonymous mail service. Card senders share with card recipients certain information beyond the notes they include with their cards, including e-mail addresses and IP addresses. IP ADDRESSES OF CARD SENDERS ARE INCLUDED IN THE E-MAIL MESSAGE HEADER OF ALL CARDS TO PROTECT THE PRIVACY OF CARD RECIPIENTS AND TO PROTECT CARD RECIPIENTS FROM ANONYMOUS ABUSE OR HARASSMENT. Under certain circumstances, recipients, their legal representatives, and/ or law enforcement authorities may be able to combine this with information disclosed by ISPs to determine the source of a particular communication. By using the Site, you knowingly and voluntarily assume any risks associated with such disclosure. This is necessary to facilitate card delivery and to protect the privacy of card recipients.
Demographic and profile data is also collected at our Site. We use this data to tailor a visitor's experience at our Site -- displaying content that might interest visitors, and displaying content according to visitor preferences. Generally, our Site automatically collects usage information, such as the numbers and frequency of visitors to our Site and its components, similar to TV ratings that indicate how many people watched a particular show. Jockular only uses this data in aggregate form, that is, as a statistical measure, and not in a manner that would identify you personally. This type of aggregate data enables us to figure out how often customers use parts of the Site so that we can make the Site appealing to as many customers as possible, and improve our services. Our Site may permit you to register as a subscriber. If so, the subscription registration form requires users to give us their email address. Users may opt-out of receiving mailings. If you register with Jockular, your user profile information including your user name, email address, and other information you enter may be displayed to other users to facilitate user interaction within the Site. We may ask for other demographic information when you register, but you can refrain from providing it. Registered users' e-mail addresses will not be directly revealed to other users by Jockular, except, when a user has chosen to include their email address in their User Profile. If you register with Jockular, your Jockular account Personal Information is protected by a password for your privacy and security. You need to ensure that there is no unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account. If you do not wish to receive email or other mail from us, please indicate this preference during the registration process.
Billing and Shipping Information:
We or our partners may also collect billing and shipping information, such as billing name and address and credit card number, if you make purchases on the Site.
If you send Jockular correspondence, via e-mail, fax, or regular mail, or if other users or third parties such as businesses send us correspondence about your activities in connection with your use of the Site, Jockular may retain that information.
Jockular does not collect Personal Information from children under the age of 13. If you believe that a child has provided Jockular with Personal Information without the consent of his or her parent or guardian, please contact us at email@example.com. If Jockular becomes aware that a child under age 13 has provided us with Personal Information, we will delete such information.You should also be aware that if you submit information to "chat rooms," "forums" or "message boards" such information becomes public information, meaning that you lose any privacy rights you might have with regards to that information. Such disclosures may also increase your chances of receiving unwanted communications.

UNDER WHAT CONDITIONS IS YOUR HAPPY PLACE PRIVACY RELINQUISHED?
Jockular may release Personal Information to legal, corporate or internet authorities if there is reasonable suspicion that an individual has not complied with our Terms of Service. Examples of such non-compliance include the use of our card system for harassment, SPAM, profanity, pornographic dissemination or illegal activity. We may release your Personal Information to comply with legal process such as a search warrant, subpoena or court order; to protect the company's rights and property; to investigate reports of users sending material using a false e-mail address or users sending harassing, threatening, or abusive messages; to protect against misuse or unauthorized use of our website and/ or the jockular.com service; or during emergencies, such as when we believe someone's physical safety is at risk.
Additionally, we employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Unless we tell you differently, Jockularé─˘s agents do not have any right to use Personal Information we share with them beyond what is necessary to assist us. You hereby consent to our sharing of Personal Information for the above purposes. Additionally, we may send offers to you on behalf of other businesses.
